Understanding the Higher Education Opportunity Act (HEOA) Requirements

George Mason University (also referred to as “George Mason” OR “or “University”) is committed to upholding the principles of intellectual property and copyright law as mandated by the Higher Education Opportunity Act (HEOA). In accordance with federal law and university policy, George Mason provides information to students, faculty, and staff to inform them and raise awareness about copyright responsibilities and penalties, as well as information about protecting unauthorized use of their own copyrighted materials. 

The HEOA requires higher education institutions, including George Mason, to practice due diligence informing students about copyright infringement risks. All higher education institutions must:

To comply with the Digital Millennium Copyright Act (DMCA) and HEOA: 

  • George Mason monitors its network for unauthorized file sharing. 
  • Users found violating copyright laws may receive “Stop It” notices and face disciplinary action. 
  • The university may be held liable for fines up to $150,000 if it fails to enforce its copyright policies. 
  • Both individuals and institutions can face fines of up to $150,000 per work for willful copyright infringement.
